Home still not sold 3 1/2 years after divorce. What to do?

The diverce order says that I have to pay 1/2 the mortgage until the house sells. The X is still living in the house for now 3 1/2 years. With housing prices falling fast and they refuse to reduce the selling price on the house to make it sellable. The "X" is very un-motivated to do anything because they are living in the home for basically 1/2 price.
Is there any suggestions or legal advise available to force them to reduce the price or refinance and take it over completely.
Also, The mortage amount still owed is somewhat higher that the current value because of the bad housing market going on now.

You are probably going to have to get a court order to force her to bring the asking price down so the house can be sold or she should be ordered to refinance if she wants to remain there.
Seek advice of legal counsel. They should be able to help.

Unfortunately for you, like many others in this country right now, you are stuck with an upside down mortgage. There’s no fixing it. You’ll have to tough it out I think. You can’t refinance if you owe more than the current value of the house, which is where many Americans are sitting right now. It *****.

Go back to court and ask to be the one who lives there until it sells? Or maybe require that it’s vacant until it sells. Have your half reduced because you’re not living there?
Just a few suggestions. I’d call the lawyer for advise.

If your looking for the bank to reduce the payoff your going to have to become delinquent on your payments a couple months, find a buyer, etc. This would be a short sale. If you can afford it, keep paying the mortgage and hope that the market rebounds to sell at a profit.

First of all, it’s your own fault for getting a divorce.
But to answer the question, you should clean it up, make it look nice, and perhaps get a good real estate person to help you sell it. Try looking at Dave Ramsey’s ELPs (Endorsed Local Providers) for real estate (source).

If you’re upside down on your mortgage I don’t know what you can legally do. I would imagine that the house is to be listed for fair market value. But I don’t know if you want to take the loss, or if you can force her to take a loss. I would consult you attorney and a financial consultant to find the right solution for your situation. I’m thinking that you might be better waiting till the market comes back and you can at least break even on your investment. You’ve already invested 3 1/2 years into it, what’s another year if it’s going to be profitable.(provided you can afford to do so)

During my divorce my ex husband had to pay 100% while living there. I would take her back to court and take your chances.
